surprises. great news. at couple cars southbound with headlights. light traffic northbound. haven't moved the cones yet. we'll look at san francisco with a smooth flow. the peninsula look is unusual. we do have a crash earlier this morning that's why we're focusing on northbound 280 in daly city. you see slowing in both directions. minor injuries reported for the single car accident but there's also one lane blocking the northbound direction. that's why the southbound is distracted as well. we'll track that and two incidents on the east bay. back to you. >> tonight president barack obama stepping up to give his state of the union address. a speech aimed at building on the progressive themes i laid out during his inauguration. will it bring together a divided congress? tracie potts is live on capitol hill with more details on tonight's address. >> reporter: tonight instead of focusing on how budget cuts will affect the pentagon, president obama will focus on the middle

class. cuts to head start, research and thousands of government jobs. >> his emphasis on the need to continue to create jobs or to continue to have our manufacturing sector expand, that work isn't done. >> reporter: in the audience tonight, the parents of a slained chicago teenager who just marched in the inaugural campaign. >> i'm happy the murderer is now off the streets. >> reporter: president will address immigration reform. a move that may have more impact outside washington. >> the goal is to move public opinion because that's what's moves congress. >> reporter: lawmakers and former lawmakers on both sides say his clear focus must be the budget. >> if we don't get it under control fairly soon, and have congress and the president lead us in this area, then we will end up with a nation which is insolvent. >> reporter: republicans are criticizing what happens after tonight's speech. president obama hits the road three cities in three days to push his agenda.

at 11:00 and of course tomorrow morning starting right here at 4:30 on "today in the bay." >> always. new this morning, the debate over a gun store in los gatos continues. it was another packed house at city hall last night. more security was brought in after one of the owners, robert chang, of the templar gun shop received a threat at his home. he sat in the audience but didn't say a word. many did speak out on the issue. >> this is not about access to guns. there are plenty of places to purchase a weapon. the question is why do we need to be one of those places. >> i think they're running a good shop. i don't think they intend to hurt anybody in los gatos. >> the council talking about passing a moratorium that would put a freeze on any new gun store from setting up shop until the council comes up with regulations. a vote is expected sometime next month.

starting next month the city of oakland is making changes to its popular first friday festival. the changes are in response to a deadly shooting that happened earlier this month. an 18-year-old student was killed and three others hurt. city officials say next month's event will end earlier and involve fewer street closures. the city is also working with event organizers in providing more activities for local teens and limiting public alcohol consumption. a judge dismissed the lawsuit filed by an alameda county family blaming police and firefighters for not coming to the aid of one of their loved ones. raymond zach waded out into the bay on memorial day in 2011. police did not go in after him because he was suicidal and didn't know if he was dangerous. firefighters chose not to rescue zach because they were not certified for land/water rescues. zach later died in the water. the judge says the responding crews did act responsibly and diligently in a very difficult situation.

4:36. brian stow is celebrating his 45th birthday this morning. he was hospitalized three weeks ago after suffering severe blood clots. doctors put a filter in his abdomen to keep clots from going into his lungs. he can only stand a few seconds at a time. a series of benefit concerts have raised more than $75,000 for stow. it's been almost two years since he was beetden aten in dodger s parking lot on opening day. leaders pressing forward on the battle for marriage equality. the city council meeting to possibly adopt a resolution in join san francisco in the upcoming brief to the u.s. supreme court on prop 8 next month. justices will hear arguments for and against the ban on same-sex marriage. the court expected to hear arguments on whether legally married gay couples have a right

to equal benefits under the law. cool start to the morning. i think there's sunshine on the way. right, christina? >> it will be so nice out there. good morning to you, laura and jon. temperatures are frigid but nothing that we're not accustomed to at this point in winter. 36 in napa. 31 in san francisco. down in the south bay just about as cold as yesterday morning. the difference is we're going to see more low cloud cover hugging the coastline today. that will keep temperatures kind of level from where we hit yesterday. i bumped your numbers up just a touch. 62 degrees inland. bayside, 61 degrees. at the coast, 60 degrees. we are still headed toward the 70s. i'll time that out for you coming up in my next report. first, let's get you to work on time on a good note with our traffic man, mike inouye. >> we're looking over here to 880. looks like the freeway is moving fine. information superhighway data coming in is sluggish sometime. that picture would show it's clear out there. we'll look at the map.

sensors show smooth flow as fremont tunnel. the onramp is construction as well as a hazard unspecified by chp on the roadways. we'll track that. so far as i know the onramp is open. they'll have flashing lights. southbound side flashing lights cleared south 880 at a street. an earlier crash cleared from lanes. took a while but no problem for 20 minutes and you see a smooth flow off 238. we're looking at the tri-valley area as well. your commute is marked with yellow arrows. west 580, south 680 not a problem. east 580 through livermore just a typical overnight road work. two lanes blocked. back to you. >> thank you very much. today 49er fans have a chance to go one-on-one with a football legend. joe montana will be in union square this afternoon in san francisco. just throw some passes to fans and sign some autographs.

and malicious intent which explains why the opening was delayed last year and why the top floor card room still is not allowed to open. starting today a brand new twist on mexican food. tofu now on the menu at chipotle thanks to the help of a small east bay company. the restaurant testing out a new vegan burrito dish. this one comes with shredded organic tofu from oakland's soy company. it's stuffed with other good things. chilies and all those spices. the tofu burrito will be tested at seven bay area locations and if diners approve, chipotle will add the dish to restaurants coast to coast. >> a mexican tradition. twitter used as a shopping tool. you may never leave home. for details on that and the rest of our news before the bell, let's turn to jackie deangelis live at cnbc world headquarters. good morning, jackie. >> reporter: good morning,

laura. tofu burrito, not sure i'm sold on that one. futures are a touch lower after stocks started the week on a down note. s&p 500 is suffering from a case of the mondays. the benchmark index is closed lower every month this year but still finishing out each week in positive territory. coca-cola reporting earnings before opening bell this morning. we saw dow falling 21 points yesterday to 13,971. the nasdaq down nearly two points to 3192. meantime, american express expanding presence on twitter letting card holders buy products directly from the social networking site. the services for customers who link their amex cards to twitter cards, items will be available. they tweet the product they want with a special hash tag. amex will ask for confirmation and your item will be sent via

the week. that's the only thing that we don't really enjoy around here is when our air quality starts to deteriorate. high pressure building in. driving winds offshore. a fog-free start to the day except at the immediate coast. patchy areas out there. 65 degrees later on in livermore. 62 along the east shore and silicon valley looking good. 63 in san jose. and 63 in los gatos. getting into the next couple days, temperatures are going to climb but slowly. we'll peak on friday. 70 degrees looks good. into the weekend 67 degrees on saturday. so comfortable conditions continue through the upcoming weekend and then monday we might get a little stray shower up in the north bay but like i said before, the jet stream stays north at least for the next ten days. back to you, jon and laura. >> thank you very much, christina. happening right now, security very tight at the u.s. consulate in thailand this morning after reported threats of a terror attack. thai officials say the attack

could come from al qaeda or other terrorists groups in that area but they are not releasing specific details about the threats. the stepped up security is expecteded ed ted to last unti weekend. it is 4:48. the u.s. security council will hold an emergency meeting this morning after north korea defied the council's orders and successfully conducted a nuclear test. state run media in north korea says the test was aimed at coping with what it calls outrageous u.s. hostility that undermines north korea's sovereign rights. the country faced tough sanctions after a december launch of a rocket that the u.n. called a cover for a banned missile test. president obama called it a highly provocative act that would undermine regional stability. closer to home, the manhunt continues as prosecutors in southern california officially charge a fugitive ex-cop with murder for killing a riverside officer. that charge against christopher

dorner could bring the death penalty. dorner has been on the run for more than a week now and it's starting week two. u.s. marshals say he might be in mexico. the website tmz reporting to have video that appears to show dorner buying scuba gear. authorities still searching in resort town of big bear lake where dorner's burned out truck was seen last week. a cruise ship carrying thousands of passengers stuck 100 miles off the texas coast. carnival cruise ship "triumph" lost power after a fire in the engine room. carnival is towing it to mobile, alabama. a woman onboard the ship was able to call her mother. she says the trip is a nightmare. >> we have no electricity in the cabins so that means no air conditioning, no lights. we're all sleeping out on the

decks. we have pulled all of our mattresses and sheets. the crew has been really, really great about putting out food for us and it's just really been a great crew. >> carnival says passengers will receive a full refund. >> that's very nice. 4,000 people on that thing. that has to be a mess. >> how do you keep that much food cold? >> they have a backup reserve but not enough to keep it going. going to get nasty. have you seen these fashion updates? a new look for one bay area sports team. why they are turning heads both on the court and off. we're looking at the east bay. the maze, emeryville moves smoothly right now. it's traffic tuesday. we'll get you a look at the south bay and show you what's going on for the changes today.

connector closed. you might have a reroute until 5:30. no slowing shows up right now. we do have changes for the south bay northbound 280 along the stretch i highlighted with yellow. onramps with metering lights starting at 6:00 a.m. this morning. that will change the flow on the freeway but also it will undoubtedly change the flow on the freeway. anywhere from the 101 interchange up to 880 for northbound 280 onramps and includes south 680 at king. we'll watch how it plays out on this traffic tuesday. mardi gras is met with bad weather down in the big easy this morning. >> a live look from bourbon street coming up in just a moment. this year beads aren't the only thing falling from the sky in the big easy. they've got soaked streets there. rain clouds covering the french quarter there. these are live pictures. not expected to wash away the celebrations. those revelers say nothing can rain on their parade.

again. a woman was hit by a stray bullet that went through a second story wind know in an apartment. fortunately though those injuries are nonlife threatening. she was in a room with her young son when she was hit. this is on the 1400 block of sycamore. when police arrived, witnesses told them quite a story. a man was standing in the street on the corner and shooting at a passing truck. that was at least a half a block away from the unit that ended up being hit by gunfire. >> it was a stray round from that shooting that actually entered this house of a totally innocent victim. a woman standing in an upstairs bedroom was hit by the stray round. fortunately it appears to be a very minor wound. >> reporter: the bullet actually hit the woman and went through a wall that was behind her. police say they have been conducting extra patrols and trying to calm things down
